Sling Coin Terms and Conditions

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING THE OFFERS AND PARTICIPATING IN THE SLING COIN PROGRAM, YOU AGREE TO BE BOUND BY THESE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE INCLUDING BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES WITH US PER THE SLING TERMS OF USE. THIS MEANS YOU GIVE UP JURY TRIALS OR CLASS ACTIONS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PARTICIPATE IN THE SLING COIN PROGRAM.
Section 1: Acceptance of the Sling Coin Terms and Conditions
These Terms and Conditions apply to your access to, and participation in, the Sling Coin Program which Sling TV L.L.C. and its affiliates (referred to as, “we,” “us,” “our,” or “Sling TV”) operate. Your access, and participation in, the Sling Coin Program is conditioned on your acceptance of these Terms and Conditions. By participating in the Sling Coin Program you agree that we may collect, use, process, share, and disclose information about you and your participation in the Sling Coin Program in accordance with our Privacy Notice. These Terms and Conditions do not alter in any way the terms or conditions of any other agreement you may have with Sling TV for other products or services.
Please note that the terms and conditions contained herein include embedded hyperlinks that may only be accessed through our websites. Section 2: About the Sling Coin Program
Welcome to the Sling Coin Program! The Sling Coin Program eligible participants are able to earn Sling Coins by completing offers located within the Offers section of the Rewards tab in the Sling TV mobile App, or in other ways as determined by Sling TV. By earning Sling Coins through the Offers section, you will be subject to the applicable terms and conditions for the applicable offer, and you agree to comply with and abide by such and the decisions of Sling TV and its representatives or the applicable third-party offer administrators. You may be asked to provide additional information, including personal information, to receive Sling Coins as part of completing an offer
Section 3: Eligibility
To join and participate in the Sling Coin Program, you must be a current active Sling TV Account holder (includes Sling Orange + Blue, Sling Orange, Sling Blue, and Sling Freestream account holders) with a Membership Account in good standing as determined by Sling TV in its sole discretion. Only Membership Accounts that are billed directly by Sling TV are eligible to earn Sling Coins.
Participants are responsible for keeping their email address up to date and private. Sling TV is not responsible for any undeliverable notifications, account security violations, or if a person redeems Sling Coins that are not their own
By participating in the Sling Coin Program, you agree to indemnify and hold harmless Sling TV from and against any and all liability arising out of or relating in any way to your participation in the Sling Coin Program and to release all rights to bring any claim, action or proceeding against Sling TV. This includes, but is not limited to, any and all claims, demands, damages and causes of action for personal injuries or death and/or damage to personal or real property, theft, loss or any other harm, suffered directly or indirectly from your participation in the Sling Coin Program or the receipt or acceptance, redemption, possession, use or misuse of the Sling Coin Program, and for any claim including claims based on defamation, publicity rights, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related or other cause of action.
Section 4: Offers and Sling Coins
- How to Earn Sling Coin: go to Rewards → Offers within the Sling TV mobile App. In order to earn Sling Coins, you must fulfill and complete all the requirements of the applicable advertising offer as set forth in the instructions and/or terms and conditions for the applicable offer. The nature of the requirements, and the amount of Sling Coins to which you are entitled to for fulfillment and completion of such requirements, are determined solely by the third-party advertiser and the owner or operator of the applicable application or website related to the offer. You can go to Rewards → Offers → Activity to check on the status of your offers, which will be designated as either Completed or In-Progress. “Completed” means that the offer has been completed pursuant to its terms and the corresponding amount of Sling Coins will be reflected in your balance, subject to the timeframe set forth below. “In Progress” means that you clicked on and commenced the offer, but have not yet completed it. You can click on the “In-Progress” offer to view a more detailed status. It may take up to five (5) business days for completed offers to be verified and reflected in your Sling Coin total.
- Sling Coin Value: each Sling Coin is worth one cent ($0.01) when redeemed for credit towards your Sling TV billing statement. A Sling Coin has no retail value and may not be exchanged, or otherwise redeemed, for cash.
- How to Redeem Sling Coin: you will need a minimum of two hundred (200) Sling Coins (or $2.00 worth of Sling Coin) in order to redeem for a credit on your Sling TV billing statement. To redeem, go to Rewards → Redeem within the Sling TV mobile App to see your total earned Sling Coin. Click the “Redeem” button and enter the amount of Sling Coins you wish to redeem as a credit to your Sling TV billing statement. If you are eligible to earn Sling Coins, but do not have an active subscription to Sling TV’s Subscription Services, you may also redeem Sling Coins upon cart checkout as a credit towards the purchase of Transactional Services and/or Subscription Services. Once redeemed, Sling Coins cannot be refunded. You will be able to see all your recent Sling Coin transactions on the Redeem tab of the Offers section within the Sling TV mobile App.
- Sling Coin Expiration: your Sling Coins will remain valid for as long as your Membership Account remains active. If your Membership Account is inactive for a consecutive period of one (1) year, then your entire Sling Coin balance will expire immediately upon the date that is one year and one day following the date of your last account activity. Your Membership Account will be deemed “inactive” for purposes of this determination if you fail to launch the Sling TV mobile App or Website using your Login Credentials for a consecutive one year period. If Sling, in its sole and absolute discretion, terminates the Sling Coin Program, you will be notified pursuant to Section 5 and any Sling Coin balance remaining will remain valid for up to one (1) year, or as otherwise determined by Sling in its sole and absolute discretion.
- You may not transfer Sling Coins to any other Membership Account.
- Customer Support: our third party partners manage the offer activity. For questions concerning an offer, please refer to the FAQs located within the “Activity” section of the Offers tab within the Sling TV mobile App or please visit http://contact.earnapplications.com/.
Section 5: General Terms
The Sling Coin Program can be terminated at any time at the sole discretion of Sling TV. Sling TV is not responsible if the Sling Coin Program cannot take place, or if any Sling Coin cannot be awarded due to cancellations, delays, interruptions or failures due to acts of God, war, natural disasters, weather, acts or threats of terrorism, actual or threatened public health crises (including without limitation an epidemic or pandemic), strikes, lockouts, labor disputes, work stoppages, fire, acts of government, or other events outside of the reasonable control of Sling TV. If, for any reason the Sling Coin Program is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of Sling TV, which, in Sling TV’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of the Sling Coin Program, Sling TV reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Sling Coin Program or any part of the Sling Coin Program. If the Sling Coin Program or any part of the Sling Coin Program is terminated or modified, notice will be posted on https://www.sling.com/rewards/coins/terms-conditions. Additionally, Sling will endeavor to notify you via email, in-app messaging, or other means reasonably determined by Sling. Any unredeemed Sling Coins at the time of the Sling Coin Program termination or modification may be void and no longer have value. Sling TV shall have no liability for any unredeemed Sling Coins at the time of termination. Failure by Sling TV to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
Sling TV assumes no responsibility for and will not redeem Sling Coins that are: invalid, altered, tampered with, unauthorized, fraudulent, or misdirected, whether caused by any of the equipment or programming associated with or utilized in the Sling Coin Program, or by any human, mechanical or electronic error that may occur in the processing of the Sling Coin Program. Sling TV assumes no responsibility for any typographical or other error in the administration of the Sling Coin Program, errors in processing offers, and the delivery of Sling Coins, any problems or technical malfunction of any telephone network or lines, mobile phone, computer systems, online systems, servers or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or on any website, or any combination thereof, including, without limitation, any injury or damage to participant’s or any other person’s computer system/software or mobile phone or other portable electronic device related to or resulting from participation or downloading any materials in the Sling Coin Program. Use of any device to automate or subvert the earning of or redemption of Sling Coins is prohibited and any Sling Coins received by such means will be void. No software-generated, robotic, programmed, script, macro or other automated Sling Coin earnings or redemptions are permitted, and any redemption requests received by such means will be void. Sling TV reserves the right in its sole discretion to disqualify any person they suspect or find: (i) to have used a software generated, robotic, programmed, script, macro or other automated system; (ii) to have tampered with the process or the operation of the Sling Coin Program; (iii) to be acting in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; (iv) to display behavior that will bring such participant or Sling TV into disgrace; (v) to have provided inaccurate information on any legal documents submitted in connection with the Sling Coin Program; or (vi) to be acting in violation of these Terms and Conditions. ANY VIOLATION OF THESE TERMS AND CONDITIONS BY A PARTICIPANT WILL RESULT IN SUCH PARTICIPANT’S DISQUALIFICATION FROM THE SLING COIN PROGRAM AND ALL SUCH PRIVILEGES WILL BE IMMEDIATELY TERMINATED.
Except as provided herein, the failure to exercise a right or require performance of an obligation under this Agreement shall not affect a party’s ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute waiver of any subsequent breach. Any provisions of this Agreement which by their express language or by their context are intended to survive the termination of this Agreement shall survive such termination
Section 6: Indemnification
You hereby agree to indemnify, defend, and hold Sling TV and its parents and affiliates, each of its and their present and future media providers, device providers, business partners, service providers, licensors, contractors, subcontractors, authorized distributors, authorized subdistributors, authorized retailers, directors, members, managers, officers, agents, employees, and other participant, and each of their respective assigns, heirs, successors, and legal representatives harmless from, against, and with respect to any and all actions, claims, disputes or demands, including reasonable attorneys’ fees and costs, that are incurred in connection with, arising out of, or relating to access to or use of our Services by you or in connection with your Membership Account, including any participant thereof, your connection to our Services, your devices, your violation of these Terms and Conditions, or your violation of any rights of another participant.
Section 7: Dispute Resolution, Arbitration Agreement and Class Action Waiver
ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE ASSOCIATED WITH THE SLING COIN PROGRAM OR UNDERMINE THE CONTENT OR THE LEGITIMATE OPERATION OF THE SLING COIN PROGRAM MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAW AND SHOULD SUCH AN ATTEMPT BE MADE, SLING TV WILL DISQUALIFY ANY SUCH PERSON, AND SLING TV RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON OR PERSONS TO THE FULLEST EXTENT PERMITTED BY LAW.
ANY DISPUTE ARISING OUT OF THIS AGREEMENT OR THE SLING COIN PROGRAM IS SUBJECT TO BINDING ARBITRATION ON AN INDIVIDUAL BASIS PURSUANT TO THE PROVISION CONTAINED IN THE SLING TERMS OF USE. THIS MEANS YOU GIVE UP JURY TRIALS OR CLASS ACTIONS.
IN THE EVENT PARTICIPANT ATTEMPTS TO BRING A CLAIM, ACTION OR PROCEEDING AGAINST SLING TV DESPITE AGREEING NOT TO DO SO IN THE ELIGIBILITY SECTION OF THESE TERMS AND CONDITIONS, AS A CONDITION OF PARTICIPATING IN THE SLING COIN PROGRAM, PARTICIPANT AGREES THAT: (I) UNDER NO CIRCUMSTANCE WILL PARTICIPANT BE PERMITTED TO OBTAIN AWARDS FOR, AND PARTICIPANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR ANY OTHER DAMAGES, OTHER THAN FOR OUT-OF-POCKET EXPENSES; (II) PARTICIPANT WAIVES THE RIGHT TO A JURY TRIAL OF ANY AND ALL ISSUES AND THAT ALL CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SLING COIN PROGRAM SHALL BE RESOLVED INDIVIDUALLY -- WITHOUT RESORT TO ANY FORM OF CLASS ACTION -- BY BINDING ARBITRATION (BY A SINGLE NEUTRAL ARBITRATOR SELECTED BY SLING TV IN ITS SOLE AND ABSOLUTE DISCRETION) ; AND (III) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, BUT IN NO EVENT SHALL SUCH CLAIMS, JUDGMENTS OR AWARDS INCLUDE ATTORNEYS' FEES. THE SLING COIN PROGRAM SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF COLORADO.
Section 8: Governing Law
These Terms and Conditions, including all matters relating to their validity, construction, performance, and enforcement, and any claim, complaint, or dispute arising out of or related to these Terms and Conditions, your relationship to Sling TV, and/or otherwise related to our Services will be governed by the laws of the State of Colorado without giving effect to its conflict of law provisions. If any provision in these Terms and Conditions is declared to be illegal, invalid, or is otherwise in conflict with any law, then such provision will automatically be considered modified to the minimum extent necessary to make such provision legal, binding, and no longer in conflict with such law, without affecting the validity of any other provisions of such Terms and Conditions, and any and all other provisions will remain in full force and effect to the fullest extent permitted by law.
You agree that any action at law, in equity, under contract (including under these Terms and Conditions), or otherwise that is excluded from, or otherwise not subject to arbitration or small claims court must be filed, and that venue properly lies, only in the state or federal courts located in the city and county of Denver, Colorado, United States of America and you hereby irrevocably consent and submit to the personal jurisdiction of such courts for the purpose of litigating such action.
Section 9: Changes to the Sling Coin Program
Sling TV reserves the right to change or modify these Terms and Conditions or any policy, FAQ, offer, promotion, benefit or guideline pertaining to the Sling Coin Program, in whole or in part, at any time and from time to time and in its sole discretion without notice to you. Any changes or modifications will be effective immediately and may be posted to https://www.sling.com/rewards/coins/terms-conditions, sso please check back from time to time. You waive any right you may have to receive specific notice of such changes or modifications, and your continued access to or participation in the Sling Coin Program following any such changes or modifications confirms your acceptance.
